Execute agreements

Authority to negotiate and execute various service agreements with outside organizations, agencies and individuals to implement approved programs and activities, whether the University is the supplier or recipient of the service, except those which contain provisions falling within the restrictions and limitations set forth in Standing Order 100.4(dd), or require approval of The Regents because of specific Regental policy, or require approval by the President pursuant to specific memoranda issued from time to time.  Notwithstanding Standing Order 100.4(dd)(10), you may execute State of Cali

Execute certain affiliation agreements with other institutions or hospitals

Approval of The Regents is required for "Affiliation agreements with other institutions or hospitals involving direct financial obligations or commitments to programs not previously approved". It is the interpretation of the General Counsel that, with regard to "direct financial obligations", the intent and meaning of this Standing Order is to require Regental approval when the direct financial obligation or commitment is imposed on the University.

Grant exceptions to the policy regarding employee-vendor relationships

Authority to approve exceptions as provided in the policy and to redelegate this authority to a specific designee; the authority may not be further redelegated.

Approve expenditures against firm commitments under contracts and grants

While firm commitment has no legal definition, it is obviously something less than a contract. The phrase is applicable to situations where University personnel are advised by representatives of Government agencies that a contract or grant will be forthcoming, and the only delay is a ministerial one of document processing. An agency representative making such a representation must be one who can be relied on for such representation.
