FLSA

Establishes minimum hourly wage. The law also establishes overtime pay requirements for non-supervisory employees. Employees may not be required to work more than forty hours per seven-dayweek without overtime compensation at a rate of not less than one and one-half times their regular pay. Exemptions from the overtime compensation provision are provided for workers who are employed in bona fide executive, administrative or professional capacity. 

Executive Orders 11,246 and 11,375

Executive Order Number 11,246 prohibits employment discrimination on the basis of race, color, religion or national origin. Executive Order Number 11,246 was amended by Executive Order Number 11375 on October 13, 1967 (32 Fed. Reg. 14,303), effective October 1968, to include gender as a protected class. 

Equal Pay Act

Prohibits sex discrimination in compensation or benefits for women and men who work in the same establishment and perform jobs that require equal skill, effort, and responsibility and which are performed under similar conditions.

COBRA

This law requires covered employers (20 or more employees) offering group health plans to provide employees and certain family members the opportunity to continue health coverage under the group health plan in a number of instances when coverage would otherwise have lapsed. The employee or qualified beneficiary may be charged 102% of the applicable premium for this benefit.

Civil Rights Act

Title VI prohibits discrimination on the basis of race, color or national origin under any program or activity receiving federal financial assistance. Sexual harassment is also prohibited under this law as are all forms of harassment based on membership in a protected class.

ADEA

Prohibits employment discrimination based on age with respect to persons who are at least 40 years of age. 

ADA

Title I of the ADA prohibits employment discrimination against a qualified individual with a disability. The law requires that reasonable accommodations be made to allow the employee to perform the essential functions of the job, or to assist the employee in the application process if necessary.
